Brenell Desserts is running a Competition (“the Competition”) where five lucky winners stand a chance of winning R3000’s worth of Brenell Dessert products (“the Prize”) when participating in the Competition. By your participation, you agree that these Terms and Conditions will govern all aspects of your relationship with the Competition and competition-related agents. These Terms and Conditions can only be modified by Brenell Desserts based on the sole discretion of the company. 

Duration, Winner Selection & Notification: 

• The competition opens on 14 October 2024. 
• The competition closes at midnight of 26 October 2024. The duration of the Competition may be extended at the discretion of Brenell Desserts.
• The winner selection and notification will take place within five days of the competition ending.
• The winner will be selected at random. This will be done by an automated process or a process that will be conducted or supervised by an independent person, or as otherwise indicated by Brenell Desserts. 
• To be eligible to claim the Prize, winners must be contactable and respond within two (2) days from the date of receipt of correspondence from the Promoter. Failure to respond within the stipulated time frame will result in the Prize being forfeited by the prize winner. In such an event, the Promoter reserves the right to award the Prize to an alternative winner.  
• Unless expressly stated within these Terms and Conditions, all other expenses incidental to the enjoyment of the Prize is the responsibility of the winner. For the avoidance of doubt, the Prize excludes transport. It is the responsibility of the winner to collect their prize from the closest Brenell stockist.
• The winner agrees to comply with such Terms and Conditions in connection with the winner's enjoyment of the Prize.  

Valid Entry: 

• There is no entry fee to enter this Competition. 
• The competition is only open to persons residing within South Africa.
• Participants must be 18 years of age or older at the time of entry.
• In order to stand a chance of winning, participants must complete the following steps: Follow the Brenell Desserts Facebook Page, share the competition post that is pinned to the top of the Brenell Desserts Facebook page and sign up to the Brenell Desserts mailing list. 
• By entering into the Competition, the participant acknowledges that he/she has been given an appropriate opportunity to first read the Terms and Conditions of the Competition before entering and that he/she understands and hereby agrees to the Terms and Conditions.  

Prize:

• The following prize is available: 5 Winners will receive R3000’s worth of products from Brenell Desserts.
• The Prize is not transferable, assignable, or refundable and cannot be substituted for cash.
• The Prize must be accepted as awarded. 
• It is the sole responsibility of the winner to collect their prize from their nearest Brenell distributor, should delivery not be available.
• Prize will be limited to one customer. 
• Claiming of The Prize expires on 18 October 2025. 

Eligibility:

Directors, members, partners, employees (including their friends and family members), agents or consultants of or any other person who directly or indirectly controls or is controlled by Brenell Desserts or marketing service providers in respect of the Competition, or the spouses, life partners, business partners or immediate family members, are not eligible to participate in the Competition. Brenell Desserts reserves the right, at its sole discretion, to disqualify your entry if it concludes that:  a) you have submitted a fraudulent entry, or, b) you have acted in violation of the Terms and Conditions of the Competition. The decision of Brenell Desserts shall be final and binding in all respects and you agree to be bound by the same. 

Limitations of Liability:
By taking part in the Competition, the participant agrees to release Brenell Desserts respective affiliates, subsidiaries, and their respective employees, agents, and representatives (collectively referred to as “the Entities") from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, losses, death that may be sustained in connection with the receipt, ownership, or use of the prize or with participation in the Competition. By taking part in the Competition, you agree that no claim relating to such injuries, damages, losses or death shall be asserted against any of the Entities.

Personal Information:

• Any personal data relating to the Winner or any other Participants will be used solely in accordance with the Protection of Privacy Information Act, 4 of 2013 and will not be disclosed to a third party without the Participant’s prior consent. 
• The Participant by taking part in the Competition consents to his/her personal information to be shared with the Promoter’s employees, contractors or agents for the purpose of this Promotional Competition and for the purpose of sharing future promotions. 

Rights of Publicity:
By participating in the Competition, the Winner hereby accepts that the Winner will be asked to take part in further publicity in relation to the Competition, with the Winner’s permission, the Promoter may incorporate the Winner in a publicity campaign, broadcast or allow their names, biographical information and any statement the winner makes in connection with the Competition or about Brenell Desserts to be used for advertising and promotional purposes aligned with the business, including but not limited to posting photo’s on Brenell Dessert's website and social media pages.

General Conditions:

• Brenell Desserts reserve the right to make changes to the Terms and Conditions of the Competition, including the substitution of a prize, which will become effective upon announcement. 
• If for any reason the Competition is not capable of being conducted as described in these Terms and Conditions, Brenell Desserts shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Competition. 
• No member of Brenell Desserts is responsible for lost, delayed, misdirect, internet or computer malfunctions, errors in transmission or any condition beyond the control of Brenell Desserts which may cause the competition to be disrupted or corrupted. 
• Brenell Dessert's decision in respect of all matters pertaining to the competition will be final and no further correspondence will be entered into.
